Beaver County case raises the bar for nursing home lawsuits
A $2,250,000 verdict against Providence Care Center and its owner, Grane Healthcare of O'Hara, was larger than any southwestern Pennsylvania jury had ever awarded. Attorneys interviewed for the story could not recall a verdict greater than $300,000 in that part of the state prior to this one, which involved a woman with dementia who fell and fractured her hip and shoulder. Jurors in the case said they could not understand how the facility let the woman suffer for months. Though she remained at the nursing home, her attorney, Carl Wilander, explained that "major moves are generally not recommended for patients with dementia, that individuals on Medicaid can encounter limitations in finding new nursing homes and that the lawsuit itself could serve as notice to the facility to avoid subsequent care problems."
