The article discusses the rules governing ex-parte communications with current and former employees of a defendant company. Mr. Stone concludes that, "any attempt to assert automatic and widespread representation of all current and former employees of a defendant must be met with skepticism. And, any efforts made to contact these individuals directly by a defense attorney for the purposes of shielding them from the informal discovery process should be challenged with a motion."
